Generally, first time offenders may face: an issuance of a fine ($300 - $1,000), some jail time (usually 10 days to 12 months) or community service (usually 40 hours), drivers license restrictions (up to one year), and in most cases mandatory attendance at an alcohol and drug education program. The punishment imposed by the judge overseeing the drunk driving case is mandatory and is often times required by state law.
If license restrictions are imposed, an offender typically has to go through some sort of DUI School to get their license back. The schooling has become a lot more involved in most states. The offender may have to go through an assessment interview with a professional counselor before their license can be returned. The professional counselor will ask questions to access the extent of the offenders drinking problem and then recommend a course of action. In some states, the counselor can adjudicate the offender into an Alcoholics Anonymous treatment program. The offender does not have to follow the treatment options suggested by their counselor, but in order to get their license back they must submit to the options provided.
Getting a hardship license, which allows the offender to go back and forth to work, has become much harder and more costly in most jurisdictions.
