Former Senator from Utah Charged with DUI

In the state of Utah, it is reported that former Senator, Sheldon Killpack, was charged with driving under the influence (DUI).  Killpack was stopped by state law enforcement after the spotted him driving erratically after he left a South Salt Lake bar on the 15th of January 2010.

When police pulled the former Senator over, he agreed to perform field sobriety tests, but refused to take a breath alcohol test.  During the field sobriety tests, police say that he lost his balance and stumbled several times.  He was arrested for suspicion of DUI and escorted to the Salt Lake County Jail.

While Killpack was in jail, police obtained a warrant to draw his blood to screen for alcohol.  His blood alcohol concentration was .11 percent.  Utah's legal limit is 0.08 percent. 

Today, Killpack was formerly charged with a class B misdemeanor for driving under the influence.  He was also charged with a class C misdemeanor for failing to signal. 

A day after he was booked into jail, Killpack resigned from his position as a Utah Senator.
