What is Implied Consent?

If you live in the state of California, it is important to understand what the "Implied Consent" laws are.

In short, should you be pulled over for a DUI, by the privilege of having a state license, you are also giving your consent to chemical testing. Should you refuse to submit to chemical testing, you automatically give up your right to drive. You will be given a choice between a breath or blood test; however, if neither is available, you can submit to an urine test instead.

In most cases, the breath test is used during a DUI stop. Breath tests are conducted using a breathalyzer, a breath machine that will measure your current blood-alcohol level. Although these machines have been in use for several decades, they are prone to malfunctions and can give inaccurate readings.

If you believe that your breath test was wrong, get in touch with a DUI lawyer now to discuss your case.
