Second DUI Charge for Man that Served Time for First Charge

First time was not the charm for a man that has already served time in prison for DUI in 2004, as he is now facing his second DUI offense, as reported by the Journal Register and the Montgomery News.

In 2004 K.M.R. went to jail for a DUI that left his friend dead.

K.M.R., 29, is currently being charged with DUI for an event in Pennsburg that occurred this past June.  Attorney Vincent A. Cirillo IV represents him. 

Acting for K.M.R., Cirillo waived his arraignment on October 17 in Montgomery County Court.  He also entered a not-guilty plea for his client.  K.M.R. did not have to appear before the judge to hear the charges formally read.

K.M.R. is free on a $2,500 unsecured bail while awaiting trial.

At approximately 7 p.m. on June 7, K.M.R. was discovered by Upper Perk Police parked in his vehicle, a Chevrolet Malibu, intoxicated.  The vehicle was parked facing north in the southbound lane of travel, against a curb, at the intersection of Main Street and West Fifth Avenue in Pennsburg.

Upper Perk Police Officer J.G.S. said, "The vehicle was running and the head lights were on. I observed a single occupant, who appeared to be sleeping in the driver's seat of the vehicle. It took several minutes of me banging on the roof and the window to wake the subject.  When the subject woke up, he opened the door and appeared very confused. He could not explain to police how he got to this location."

Officer J.G.S. said that he detected alcohol on K.M.R.'s breath, slurred speech and that the defendant had red, glassy eyes.

K.M.R.'s blood alcohol test proved to show that he had 0.20 percent - and the state legal driving limit, set at 0.08 percent, is less than half of that.

Cirillo said, "Right now, we're weighing all our options.  He had been attending outpatient treatment when this alleged incident occurred."

In the 2004 incident K.M.R., 23 at the time, was sentenced to 18 to 36 months in county jail, two years of probation and 100 hours of community service.

He had pleaded guilty to charges that included homicide by vehicle, recklessly endangering another person and DUI.  The crash, occurring on March 27, 2004, took the life of his friend and roommate, K.L., 23.

During his September 20005 hearing, K.M.R. said through his tears, "It changed my life, what happened that night. I'll never play with people's lives again."

His blood alcohol, in this earlier incident, registered 0.10 percent.

State police at Skippack said the crash occurred at approximately 12:10 a.m. on Route 663 in Upper Hanover.  K.L. had been sitting in the front seat of a 1994 Jeep Grand Cherokee driven by K.M.R.

K.L., after suffering multiple injuries in the crash, died at the scene.  One other passenger, D.W., was injured and K.M.R. suffered injuries after being ejected from the vehicle.

According to the criminal complaint in this earlier accident, K.M.R. traveled north, loosing control of his vehicle when he tried to stay on the road at its curve.  He instead drove into a utility pole on the west side of the two-lane highway.   His speed was ascertained at 61 to 73 mph in a 45 mph zone.
