Man Gets Tougher Sentence for Multiple DUI

A man who went to his sentencing intoxicated is likely to receive a harsher punishment than the judge had first intended.

Since the man is no stranger to DUI charges, this was his third DUI, the judge followed the prosecutors wishes to deny the man a 90 day mandatory jail sentence that is applied to other DUI cases. Instead, he was sentenced to 90 days house arrest, followed by five years of probation. In addition, the judge demanded that the man attended an Alcoholics Anonymous meeting at least three times per week.

Yet when the prosecutors learned that the man had shown up drunk to his sentencing, registering 0.16 blood-alcohol level, they demanded a tougher sentence. Yet, his attorney argues that the man did nothing illegal by appearing at court drunk. In fact, it only strengthened the judge's argument that the man needs counseling and AA meetings to improve.
