California DUI Expungement

In the state of California, a DUI conviction can be expunged from your record. Expungement does not mean that the charge is completely erased from your record. Instead, your guilty or no contest plea is withdrawn, or if you pleaded not guilty and were convicted, the guilty verdict will be set aside. You are then "released from all penalties and disabilities resulting from the offense" of which you were convicted. If you have been convicted of a DUI in Southern California, a Los Angeles DUI Defense Attorney may be able to have your conviction expunged. DUI expungements are only possible for misdemeanor convictions. It is possible, however, for a DUI lawyer at our firm to have your felony DUI charge reduced to a misdemeanor and then expunged.

California Expungement Eligibility:

  • You must have completed your probation or had it terminated early.
  • You cannot be serving a sentence for another offense.
  • You cannot be on probation for another offense.
  • You cannot have been charged with the commission of another offense.
  • Some courts will not grant an expungement if you violated your probation, although this is left to the discretion of the judge.

After a California DUI Expungement:

  • You will no longer have to disclose your DUI conviction when applying for jobs in the private sector.
  • You will have to disclose your expunged DUI conviction if you run for public office.
  • You will have to disclose your expunged DUI conviction if your profession requires a state license, such as doctors, lawyers, stock brokers, and real estate agents.
  • You will have to disclose your expunged DUI conviction if you apply to become a law enforcement officer.
  • You will have to disclose your expunged DUI conviction if you apply to become a Peace Officer.
  • You will have to disclose your expunged DUI conviction if you contract with the California State Lottery.
  • If you are charged with DUI again in the next ten years, even an expunged DUI conviction will count as a priorable offense and the penalties for the second DUI will be harsher.
  • If gun ownership privileges were revoked, expungement will not reinstate them.
