Facts About the Breathalyzer Test and DUI

By Gold & Witham  Apr. 18, 2011 12:55p

If a person gets pulled over on suspicion of driving under the influence, one of the things he may be requested to do is take the breathalyzer test. This is a test to determine the alcohol concentration in your blood. When defending a person against a DUI charge, a competent DUI attorney can investigate the procedures used and check to see that the reading given by the test was accurate. If there was any deviation from proper testing procedure or if the results were in any way inaccurate, this may enable the attorney to request the evidence not be used, putting you in a position where the charges against you may be lessened or possibly even dropped.

The Breathalyzer Test Itself

When the breathalyzer test is administered there are three main areas where things can go wrong:

  • The equipment itself may be faulty
  • The test can be administered incorrectly
  • The person being tested may have some medical or physical condition that changes the results of the test and a blood alcohol concentration (BAC) reading shows to be higher. Physical conditions like diabetes, acid reflux, heartburn or even special diets can all have an effect on the breathalyzer.

An experienced DUI attorney can investigate to see if any of these are applicable to a case. If any of the above points did go wrong, the evidence may be suppressed.
