Penalties for Charges of DUI

Have you or someone you know been arrested for driving under the influence of alcohol or other substance that is known to impair driving in the Tampa area? DUI laws have become tougher than ever before in all 50 states. The State of Florida drunk driving laws prohibit driving any type of vehicle with a blood alcohol concentration of .08 percent. This limit is even lower for commercial drivers (.04%) and almost nothing for drivers under the age of 21 at (.02%). How many drinks would it take you to reach the legal limit? There is no exact formula; height and weight are factors in determining just "how much" alcohol it takes to become legally impaired.

Drunk Driving Penalties in Florida

The State of Florida has harsh laws for driving under the influence. If you drink and drive, your chances of being in a crash vastly increase.  If you are pulled over, an officer will ask you to take a blood, urine or breath test and you are required to comply. Refusal to comply will result in an immediate license suspension for one year. DUI penalties for the first conviction include:

  • Pay a fine up to $500
  • Community Service - 50 Hours
  • Probation
  • Imprisonment - Not more than 6 Months
  • Imprisonment with BAL of .08 or higher with a minor in the vehicle, not more than 9 months
  • License Revocation - Minimum of 180 days
  • DUI School- 12 Hours

With each additional DUI conviction, the penalties become more severe. Florida law requires all drivers convicted with a second DUI to have an Ignition Interlock Device. Every time you get into your car to drive you breathe into the device to start the car, five minutes later the device beeps and you have to breathe again into the device.  The process is then repeated about every 30 minutes. The information is recorded and transmitted to the Florida DMV.
