Man Arrested for DUI after Leaving Car in Middle of Road

At about 1:30 a.m., patrolling officers spotted a vehicle that had been left running in the middle of the road with no driver. The lights and engine were on and the driver's side door was ajar. The officers pulled up closer to investigate and saw a man near the side of the road apparently relieving himself. The man got back into the car a short time later. The officers turned on their emergency lights and stopped the driver from leaving the location. The officer who spoke to the man who had returned to the car and became suspicious that the driver was intoxicated. The driver, 25-year-old C.C., was asked to turn off the engine and then he and his passenger were questioned about if they had anything to drink that evening. C.C. said he hadn't had anything to drink. Police reports state that the officer observed that C.C.'s eyes were bloodshot and his speech was slurred. He also said he smelled the odor of alcohol whenever C.C. spoke. Officers also stated that there were nearly empty open bottles of beer behind the driver's seat in plain sight. C.C. was asked to step out of the vehicle and perform a field sobriety test. He was put through the horizontal gaze nystagmus, one leg stand and the walk and turn and allegedly failed all three before the officer asked the man to perform a breathalyzer test. C.C. refused to take a chemical test and was subsequently arrested on suspicion of DUI per Rhode Island law. He was booked on a first offense DUI with blood alcohol unknown and refusing a chemical test. He was also cited for having open alcoholic beverages in his car. His passenger, O.C., 22 years old, was also taken into custody after officers discovered that he had an arrest warrant out on him for failing to appear at RI Superior Court.
