Man Gets 5 Years for DUI Manslaughter

This week Tuesday, financial broker who crashed his Mercedes after driving under the influence at speeds of more than 100 mph on the Eisenhower Expressway was sentenced to five years in prison after killing a young mother in 2007.

38-year-old Michael Penachio received jail time after pleading guilty to killing 22-year-old Danielle Baker, who was an aspiring journalist and a mother of a four-year-old girl.

Originally, Penachio's lawyer sought probation as a sentence.  After pleading guilty before Judge Thomas Hennelly, Penachio turned around in court and faced the Baker family and apologized for his actions.

Prosecutors say that he had a blood alcohol level of .19 when he crashed into Baker's vehicle.  Penachio's blood alcohol level was more than twice the legal limit and after the accident, he sped away from the scene.
