Your Driver’s License Suspension

After you have been arrested for DUI in California, the arresting officer will confiscate your driver’s license. The arresting officer will then issue you an Order of Suspension and a Temporary License, which allows you to drive for 30 days from the date of the order of suspension or revocation. This is under ordinary circumstances, if your driver’s license was expired, or suspended for another reason, this would not apply.

You have exactly 10 days from the Notice of Suspension to request an administrative hearing. This hearing is very important and it will determine the future of your driving privileges. The hearing will be an opportunity for you and your DUI defense attorney to prove that a license revocation is not justified.  

A DMV suspension or revocation is separate from any court-imposed fines, jail sentence or criminal penalties. The DMV administrative hearing serves to address your driving privileges only.
