Drunk Driving Laws in South Carolina

By Masella Law Firm, P.A.  Jul. 10, 2013 11:40a

Like all the other states, South Carolina makes it illegal to drive with a blood alcohol concentration (BAC) of .08 percent or more, regardless of whether you are demonstrating an impaired ability to drive or not. Once you accept your driver's license in the state, you are subject to "implied consent" law which means that you must submit to a chemical test to determine your BAC level if requested by law enforcement. Those who refuse to take a chemical test on suspicion of drunk driving will lose their driving privileges for a specific time period, based on whether it is your first, second, third, or a subsequent refusal. A first-time refusal results in a 6-month license suspension.

South Carolina has serious penalties for those who drive under the influence of alcohol and / or drugs. A first conviction carries a minimum of a $400 fine; this fine, however, may range as high as thousands of dollars. A conviction may also include the possibility of a jail sentence of up to 30 days. In cases where your BAC is extremely high, your jail sentence may be longer. Alternatively, you may be required to serve 48 hours of community service. Your license will likely be suspended for six months. You will also likely be required to participate in an alcohol education program and / or a treatment program at your own expense. Your auto insurance premiums will also increase. Repeat offenders will have more severe penalties and will be required to install an ignition interlock device on their vehicles at their own expense.

A first offense is charged as a Class B misdemeanor which means that if you are convicted you will have a permanent mark on your criminal record.
