DUI and Unlawful Police Stops

By Gold & Witham  Apr. 18, 2011 12:31p

When a policeman pulls someone over for suspicion of DUI, he or she must have valid reason for doing so. They must have directly observed some sort of behavior that indicated intoxication or impairment. Law enforcement will look for driving behavior that is out of the ordinary such as driving too slowly, driving too fast, swerving into other lanes, hitting objects on the side of the road, or other inappropriate driving behavior.

Mistakes Do Happen

Sometimes mistakes can happen and people can get pulled over and charged with DUI when there was not probable cause - this is in violation of an individual's rights. Drivers are being encouraged to report any erratic driving they see around them and with cell phones, this is easy to do. It could be that someone called in to the police and described a vehicle that looked like yours and you were wrongly targeted for DUI. If the officer did not observe any unusual behavior himself, he may not have just cause for pulling you over. Another few points to be considered would be did you violate any traffic laws or were you pulled over for no legitimate reason; were you displaying any erratic or out of the ordinary behavior while driving?
