The Winnebago County, Illinois State's Attorney's office is currently working with Stateline hospitals to draw blood in fatal DUI cases. Attorney Joe Bruscatto is clarifying a law already in the books the way it is right now local hospitals are declining the police department's request to draw blood on a DUI suspect who refuses to give it in fear of being sued. However, now hospitals no longer have a choice in taking the samples considering police can now use a search warrant law to enforce the blood draw.
