Defense Attorney Challenges Breathalyzer Law

A defense attorney in Hawaii is challenging a state law that doesn't require repeat drunk driving offenders to install special software in their vehicles.

Attorney Paul Cunney believes that repeat offenders should be required to have an in-car breathalyser installed, and that the state law should enforce this. He told Hawaii News Now that says these drivers are not covered by the law that requires offenders to give up their vehicle registration if they have more than one offense in a five-year period.

The reasoning goes that if an offender doesn't have their car they certainly cannot have an ignition interlock device installed in it.

At this time State Rep. Sharon Har has stated that she wishes to modify the law, although at what time has not been announced.
